On May 22, US District Court Judge Jeffrey White of the Northern District of California blocked the Trump administration from terminating the immigration status of international students. Judge White wrote in his order that the Trump administration “likely exceeded their authority and acted arbitrarily and capriciously” when officials terminated students’ legal status in the Student and Exchange Visitor Information System (SEVIS) database.
Judge White’s order bars the government from arresting, detaining, or transferring students while similar cases are pending.
Background: In early April, the Trump administration revoked hundreds of thousands of international students’ and scholars’ visas and terminated SEVIS status. Amidst legal challenges, DHS stated that it has paused the termination of students’ SEVIS records.
Judge White wrote, “The relief the court grants provides Plaintiffs with a measure of stability and certainty that they will be able to continue their studies or their employment without the threat of re-termination hanging over their heads.”
