On July 1, 2025, a New York federal judge has blocked the Trump administration’s attempt to end Temporary Protected Status (TPS) for Haitian nationals ahead of schedule, preserving protections for up to 500,000 Haitians currently residing in the United States.
The ruling, issued by US District Judge Brian M. Cogan, halts the Department of Homeland Security’s (DHS) plan to terminate Haiti’s TPS designation on September 2, 2025 – five months earlier than the expiration date set by the Biden administration, which had extended the designation through February 3, 2026.
Legal Basis for the Ruling
Judge Cogan found that DHS’s early termination violated provisions of the TPS statute, which require that any reconsideration of a country’s designation must not take effect before the expiration of the current term. He emphasized that TPS recipients had made life decisions—such as enrolling in school, securing employment, and beginning medical treatment—based on the expectation that their legal status would remain valid through early 2026.
“When the Government confers a benefit over a fixed period of time, a beneficiary can reasonably expect to receive that benefit at least until the end of that fixed period,” Cogan wrote in his 23-page opinion.
Context
The ruling comes just days after DHS Secretary Kristi Noem announced the early termination, citing improved conditions in Haiti. However, the State Department continues to advise against travel to Haiti due to widespread violence, civil unrest, and limited access to healthcare.
This decision is part of a broader legal and political battle over the future of humanitarian immigration programs. The Trump administration has sought to roll back TPS and parole protections for nationals from several countries, including Venezuela, Cuba, Nicaragua, Cameroon, and Afghanistan. In May, the Supreme Court allowed the administration to revoke TPS for approximately 350,000 Venezuelans.
