BREAKING NEWS — DEVELOPING STORY – This morning, Judge Joseph N. Laplante of the U.S. District Court for the District of New Hampshire blocked the Trump administration’s executive order (EO) to end Birthright Citizenship, one of the most contentious EOs from this term.
Judge Laplante issued a preliminary injunction against the enforcement of the EO while the case proceeds and provisionally certified the case as a class-action lawsuit applicable to all affected babies and parents.
What’s next: The decision today upholds the Constitutionally enshrined principle that people born in the United States are automatically American citizens, thereby thwarting the EO from taking effect in 28 states on July 27, 2025. Judge Laplante stayed his order for seven days, which allows time for appeal.

Background: On June 27, 2025, in a significant legal development, the U.S. Supreme Court ruled 6–3 in favor of the Trump administration. Their decision to limit the scope of nationwide injunctions allowed the Trump administration to move forward with its plan to end automatic birthright citizenship. The Supreme Court decision did not rule on the constitutionality of the policy itself.

The June 27 Supreme Court ruling restricted injunctions to only the states, groups, or individuals who brought the lawsuits. As a result, the administration would otherwise be able to begin implementing its birthright citizenship policy in the 28 states that did not challenge it in court.

Due to the limitations on nationwide injunctions, a nationwide challenge to the Birthright Citizenship EO could only be structured as a class-action lawsuit. The ACLU filed nearly immediately after the Supreme Court’s decision.
