On July 31, 2025, following a recent federal court decision that blocked the early termination of TPS for Haitian nationals, another federal judge has halted the US government’s attempt to terminate Temporary Protected Status (TPS) for approximately 60,000 individuals from Nepal, Honduras, and Nicaragua. The ruling ensures continued protection for these nationals while litigation proceeds.
Background: TPS is a humanitarian program that allows nationals from designated countries to live and work in the United States temporarily when returning to their home countries would pose serious risks due to armed conflict, natural disasters, or other extraordinary conditions. The Trump administration had sought to end TPS designations for these countries, arguing that conditions had improved sufficiently to warrant termination.
US District Judge Trina L. Thompson ruled that the administration failed to conduct an objective review of current country conditions. Her decision cited ongoing political instability in Honduras, the aftermath of recent hurricanes in Nicaragua, and human rights concerns in Nepal. The court found that ending TPS without proper evaluation would cause irreparable harm to recipients and their families, including loss of employment, health coverage, and the risk of deportation.
Judge Thompson also noted that the termination would have broader economic consequences, estimating a potential $1.4 billion loss to the US economy. In her written opinion, she criticized the administration’s rationale, suggesting that the decision was influenced by discriminatory motives rather than sound policy.
The next hearing in the case is scheduled for November 18, 2025. Until then, TPS protections for nationals of Nepal, Honduras, and Nicaragua will remain in place.
